Triptimize Terms of Service

Welcome to Triptimize. By accessing or using our application, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the application.

 

1. Use of the Application

Triptimize provides travel planning tools and content recommendations to help users optimize their itineraries. You must be at least 18 years old to use our services.

 

2. User Data and Information Ownership

By using the Triptimize application, you agree that:

 

  1. We may collect data related to your interactions with the application, including searches, preferences, session usage, and any feedback submitted.
  2. Triptimize retains full and perpetual ownership of all non-personally identifying information (non-PII) generated through your use of the application.
  3.  Non-PII may include aggregated analytics, behavioral patterns, location metadata (if anonymized), device type, feature usage statistics, and preferences.
  4. This data may be used for purposes such as improving our service, personalizing your experience, developing new features, and informing business strategies, including commercial uses such as selling anonymized data sets or generating travel trend reports.
  5. We do not claim ownership of your personal data (e.g., your name, email, or identifiable travel history), which is governed by our [Privacy Policy].

3. Account and Conduct

You are responsible for any activity that occurs under your account. You agree not to misuse the application or use it for unlawful purposes.

 

4. Termination

We reserve the right to terminate or suspend access to the application at our sole discretion, without notice or liability, for any reason, including violation of these Terms.

 

5. Intellectual Property

All content, branding, features, and functionality on Triptimize are owned by Triptimize LLC and protected by copyright, trademark, and other laws.

 

6. Disclaimers

 

The service is provided "as is" without warranties of any kind. We do not guarantee the accuracy or availability of travel content or third-party services.

 

7. Limitation of Liability

To the maximum extent permitted by law, Triptimize LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the application. This includes, but is not limited to:

a. Venue Data Accuracy

  • We rely on third-party sources such as Google for information about locations, including operating hours, days of operation, business status (open/closed), and imagery.
  • We do not verify this information independently.
  • We are not liable for:
    • Venues being closed or out of business despite being shown as open.
    • Incorrect or outdated hours of operation.
    • Misinformation or omissions related to services offered by a venue.
    • Images, names, or details that do not reflect the current state of a location.

 

b. Third-Party Availability

  • We do not guarantee the availability or accuracy of information provided by external platforms, APIs, or services we use to power trip suggestions and content.

c. User Decisions Based on Data

  • You assume full responsibility for any decisions you make based on the recommendations, content, or information surfaced by Triptimize.
  • We encourage verifying details with the venue directly before making time-sensitive or cost-sensitive plans.

 

d. User-Generated Content

  • You are solely responsible for the content and data you submit, post, or display using the application.
  • Triptimize assumes no responsibility or liability for user-generated content, and we reserve the right to remove content that violates our terms or is otherwise objectionable.

 

8. Governing Law & Arbitration

a. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

 

b. Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Triptimize app, or the information provided by the app shall be resolved exclusively and finally through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

 

c. Arbitration Venue & Jurisdiction

The arbitration shall be conducted in Phoenix, Arizona, and each party waives any objection to jurisdiction or venue. The arbitration shall be conducted by a single arbitrator with experience in software, travel services, and internet commerce.

 

d. No Class Actions

To the fullest extent permitted by law, you agree that you may bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

 

e. Limitation of Claims

All claims must be brought within one (1) year after the cause of action arises, or such claim is permanently barred.

 

f. Injunctive and Preliminary Relief

Triptimize reserves the right to seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

 

g. Indemnity and Limitations

You agree that Triptimize is not liable for any damages resulting from your use of third-party data including but not limited to:

i. Incorrect or outdated business hours

ii. Closures or relocations of venues

iii. Inaccurate images, descriptions, or venue information All data is pulled from third- party sources such as Google and is provided "as-is" without any guarantee of accuracy or suitability.

 

h. Waiver of Trial

You knowingly and voluntarily waive any right to a jury trial or to participate in a court proceeding related to any claim covered by this agreement.

 

9. Force Majeure

 

Triptimize shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet service interruptions, power failures, or governmental actions.

 

10. Modifications to the Terms

Triptimize reserves the right to modify these Terms at any time. If we make material changes, we will provide notice through the application or via email. Continued use of the application after changes are posted constitutes acceptance of the updated Terms.

 

11. Entire Agreement

These Terms constitute the entire agreement between you and Triptimize LLC regarding your use of the application and supersede any prior agreements between you and us.
